Terms and Conditions of Internet Banking – Perdania Direct

Article of 1

Terminology

1.1.

Internet Banking - Perdania Direct is one of PT Bank Resona Perdania product to ease banking transaction thru internet by using browser.

1.2.

 

Bank is PT Bank Resona Perdania, comprising the headquarter, branch, and sub branch, which constitute an integral part of PT Bank Resona Perdania.

1.3.

Customer is personal or company that owns current account in the Bank.

1.4

Customer Admin is Customer that has been registered as customer admin of Internet Banking - Perdania Direct.

1.5

User is Customer that has been registered by Customer Admin of Internet Banking - Perdania Direct.

1.6

Account Listis Customer account number that has been registered therefore accessible through Internet Banking-Perdania Direct by User.

1.7

Corporate ID is Customer information owns by Customer and shall be inputted by Customer Admin and/or User for Internet Banking - Perdania Direct use.

1.8

User ID is user assign by Bank or user assign by Customer Admin. User ID terdiri dari: User ID consist of :

 

a.

Connection User ID is use by Customer Admin and/or User to connect to Internet Banking - Perdania Direct.

 

b.

Application User ID is use by Customer Admin and/or User to login to Internet Banking - Perdania Direct.

1.9

Password is personal identification, which is strictly confidential and only known by Customer Admin and/or User and shall be inputted by Customer Admin and/or User for Internet Banking - Perdania Direct use.

Password consist of :

 

a.

Connection Password is a permanent Password that use by Customer Admin and/or User to connect to Internet Banking - Perdania Direct.

 

b.

Application Password is Password that use by Customer Admin and/or User to login to Internet Banking - Perdania Direct.

1.10

Token Perdania Direct is additional device to secure banking transaction thru Internet Banking - Perdania Direct.

1.11

Response Number is dynamic number generated by Token Perdania Direct to identify User.

1.12

Transaction Status is menu provides status of the executed transaction thru Internet Banking - Perdania Direct within maximum 90 (ninety) days.

1.13

Account Statement is menu provides information of banking transaction of all User account stated in Account List and conducted within maximum 3 (three) months, exclude current month.

1.14

Transaction Inquiry is menu provides information of banking transaction of all User account stated in Account List and conducted within maximum 90 (ninety) days.

Article of 2

Internet Banking-Perdania Direct Registration

2.1

Customer entitles to enjoy Internet Banking-Perdania Direct facility by meeting the following requirements:

 

a.

Fill out and sign the Application for Internet Banking-Perdania Direct that obtainable at Bank or can be downloaded at Bank’s website (www.perdania.co.id); and

 

b.

Provide photocopy of valid personal identity (Resident Identity Card/Driving License/Passport/ Temporary Stay Permit); and

 

c.

Possess e-mail address.

2.2

Customer Admin and/or User must read, understand, agree, and subject to this Terms and Conditions of Internet Banking-Perdania Direct.

2.3

Customer Admin has obtained Corporate ID, User ID, Password, and Token Perdania Direct from Bank.

2.4

User has obtained Corporate ID, User ID, Password, and Token Perdania Direct from Customer Admin.

2.5

Token Perdania Direct is assign to releaser access level.

 

Article of 3

 

Stipulations in Using Internet Banking-Perdania Direct

3.1

Customer Admin use Internet Banking - Perdania Direct to manage access control in Internet Banking - Perdania Direct.

3.2

User use Internet Banking - Perdania Direct to get information and/or banking transaction.

3.3

Customer Admin activate the Internet Banking-Perdania Direct service by contact Internet Banking support.

3.4

For every execution of transaction

 

a.

User is required to ensure the adequacy of balances in Account List before conducting the transaction.

 

b.

User must ensure the accuracy and completeness of the instruction given to Bank, including all data required for transactions are complete and correct. Bank is not responsible for any consequences caused by negligence, incomplete, ambiguous, or inaccurate instruction or data from User.

 

c.

System will always perform validation to the data entered by User and will request Response Number as additional security measure. User has a chance to cancel the data by pressing “Cancel” button before approval is given as set forth in the point below.

 

d.

If User has already ensured the accuracy and completeness of the instruction that is given to the Bank, User should enter “Approve”.

3.5

User may not cancel the instruction after submission.

3.6

Any instruction that has been approved by the User and stored in Bank’s database is the accurate and valid which is accepted as proof of instruction from User to Bank to perform the requested transaction.

3.7

Bank accepts and performs every instruction based on the usage of Corporate ID, User ID, Password, and Token Perdania Direct, thus Bank is not obliged to examine the authenticity, legality, or authority of the user of Corporate ID, User ID, Password, and Token Perdania Direct; or to evaluate the accuracy or completeness of the instruction, and therefore the instruction is valid and binds the User when received by Bank, unless User can prove otherwise.

3.8

The transaction instruction from User could not be executed, if:

 

a.

The User balance in Bank is not sufficient; and/or

 

b.

The account has been closed, confiscated, or disabled; or

 

c.

Bank has known or has a reason to suspect that a fraud or crime has been or will be committed.

3.9

User will receive transaction advice in the form of reference number for each executed transaction. It will be sent to User email, which registered by Customer Admin.

3.10

Subsequent to the performing transaction, User can find the transaction instruction that has been executed by Bank based on the proof of instruction through Transaction Inquiry menu.

3.11

User agrees and acknowledges that:

 

a.

By the execution of the transaction through Internet Banking-Perdania Direct, all instructions from User that are received by Bank will be used as legal evidence, although they are neither in written form and/or signed.

 

b.

Any evidence of the User’s instruction to Bank which has been transmitted electronically and stored in Bank’s database and/or in the other forms of information and data storage in the Bank, either in the form of written documents, record, tape/cartridge, computer printout, and/or copy, shall constitute a legal evidence instrument that is indisputable on its legitimacy, truth, or authenticity.

3.12

Bank has the right to terminate Internet Banking-Perdania Direct service temporarily or for a specified period of time as specified by the Bank for renewal, maintenance, or other purposes for any reasons deemed necessary by the Bank, and hence the Bank is not responsible to justify this to anyone.

3.13

Transaction that is submitted after cut of time or on Bank holidays will be processed on the next business day of Bank according to the prevailing regulations.

Article of 4

Rates

4.1

Information on foreign exchange rates, interest rates, and other rates provided in Internet Banking-Perdania Direct are only indicative of the prevailing rates, and can be changed at any time by Bank and the changes are available in the form and thru any media in the Bank.

4.2

User’s transactions in foreign currencies use the exchange rates that are specified by the Bank, when the transaction is executed.

Article of 5

Corporate ID, User ID, Password, and Token Perdania Direct

5.1

Corporate ID, User ID, Password, and Token Perdania Direct are codes that are confidential and can only be used by User.

5.2

Bank has the right to give User ID with the combination of letters and numbers without Customer Admin approval at first.

5.3

Customer Admin and/or User must ensure that all transactions performed within Internet Banking-Perdania Direct are always being performed under full supervision of the Customer Admin and/or User, and when Customer Admin and/or User leaves the terminal in active state (logged in), the Bank’s system will automatically terminate Internet Banking-Perdania Direct session after 10 (ten) minutes of inactivity to prevent unauthorized use.

5.4

Customer Admin and/or User must ensure the secrecy of Corporate ID, User ID, and Password by:

 

a.

Never inform Corporate ID, User ID and Password to other party for profit or other purposes.

 

b.

Never write down Corporate ID, User ID and Password on paper or other storage media that can be discovered by unauthorized party.

 

c.

Corporate ID, User ID and Password must be used protected in order not to be known by unauthorized party.

 

d.

Never use the Password that can be easily guessed number such as date of birth, phone number, etc.

 

e.

Change Password periodically.

5.5

Customer Admin and/or User is fully responsible for the safety and secrecy of Corporate ID, User ID and Password and all forms of transaction instructions that occur based on the usage of User ID, and Password owns by Customer Admin and/or User.

5.6

User is fully responsible for the safety and secrecy of Token Perdania Direct for all transaction instruction based on Token Perdania Direct owns by User.

5.7

Customer Admin and/or User responsible to secure Password and given written letter to Bank if Customer Admin and/or User notice or suspect unauthorized access know Corporate ID, User ID, Password and Token Perdania Direct. Any instruction using unauthorized access for Corporate ID, User ID, Password and Token Perdania Direct that occur prior to the authorized Bank officials received an official written report is the responsibility of Customer Admin and/or User completely.

5.8

The use of Corporate ID, User ID, Password and Token Perdania Direct has the same legal force as signed written instructions by Customer Admin and/or User, and therefore user hereby declares that the usage of Corporate ID, User ID, Password and Token Perdania Direct in every transaction instruction through Internet Banking-Perdania Direct is also the constitute an irrevocable and unconditional special full authorization with substitution and retention rights from Customer Admin and/or User to the Bank to perform the transaction, including but not limited to debit User’s account either as part of execution of the instructed transactions or for covering the transaction charge that has and/or will be specified later by Bank.

5.9

Customer Admin takes full responsibility for any misuse of Corporate ID, User ID, and Password and therefore, User hereby indemnifies Bank of all liabilities or claims that may arise either from other party or Customer Admin and/or User as the result of the misuse of Corporate ID, User ID, and Password.

5.10

User takes full responsibility for any misuse of Corporate ID, User ID, Password and Token Perdania Direct and therefore, User hereby indemnifies Bank of all liabilities or claims that may arise either from other party or Customer Admin and/or User as the result of the misuse of Corporate ID, User ID, Password and Token Perdania Direct

Article of 6

Electronic Mail (E-mail)

6.1

E-mail address that was registered by Customer Admin at the time of Internet Banking-Perdania Direct registration will be used by Bank to send information to Customer Admin.

6.2

User e-mail address that was registered by Customer Admin at the time of Internet Banking-Perdania Direct registration will be used by Bank to send information to Customer Admin.

6.3

Bank only sends information of Customer Admin to e-mail address that has been confirmed its validity by Customer and therefore Bank is not responsible for any invalidity of the e-mail address.

6.4

Bank only sends information to User e-mail address that has been confirmed its validity by Customer Admin and therefore Bank is not responsible for any invalidity of the e-mail address.

6.5

Customer Admin and/or User should not register free e-mail such as yahoo, gmail, etc.

6.6

Bank does not guarantee the security of information or data being sent from Customer Admin and/or User to Bank through e-mail that is not registered in Internet Banking-Perdania Direct, and not in secure format that is agreed or specified by Bank.

Article of 7

Blocking of User-ID and Password

7.1

User-ID and Password of Customer Admin and/or User will be blocked in the following events:

 

a.

 

Customer Admin and/or User enters incorrect Password 3 (three) times consecutively when login; or

 

b.

Customer Admin and/or User enters incorrect Token Number 3 (three) times consecutively when making financial transactions; or

 

c.

Customer Admin and/or User notices or suspects that User-ID and Password have been known by other unauthorized party and Bank has been received such official written report to disable the Internet Banking-Perdania Direct access; or

 

d.

Bank identifies the possibility of User-ID and Password of Customer Admin and/or User have been known by other unauthorized party.

7.2

Customer Admin has to inform Bank if User-ID and Password had been blocked.

7.3

User has to inform Customer Admin if User-ID and Password had been blocked.

Article of 8

Termination of Service

8.1

Internet Banking–Perdania Direct service will be terminated if:

 

a.

User proposes official written request to Bank for terminating the service; or

 

b.

User closes all accounts that can be accessed through Internet Banking-Perdania Direct; or

 

c.

Bank receives official written report from User that the User-ID and Password are known or alleged by other unauthorized party; or

 

d.

Bank acts on prevailing law; or

 

e.

Bank mengalami gangguan atau menghentikan pemberian jasa layanan Internet Banking-Perdania Direct. Atas penghentian tersebut, Bank akan menyampaikan pemberitahuan kepada Nasabah Pengguna dalam bentuk dan melalui sarana yang umum digunakan oleh Bank.

8.2

User has to return Token PIN Perdania Direct to Bank if Internet Banking-Perdania Direct service is terminated.

Pasal 9

Force Majeure

Customer Admin and/or User shall relieve the Bank of any claims, in cases where Bank’s system cannot execute the instructions from the Customer Admin and/or User, in part or in whole, or because events beyond the control or capability of the Bank, including but not limited to all disturbance by computer virus, Trojan Horses system failure, or hazardous components which may affect the Internet Banking-Perdania Direct service, the web browsers or the computer system of the Bank, Customer Admin and/or User, or Internet Service Provider due to natural disaster, war, riot, equipment conditions, non-functioning system or transmission, power outage, telecommunication failure, government policy, and other events or causes beyond the control or capability of the Bank.

Article of 10

Others

10.1

The physical evidence of User’s instruction successfully carried out through Internet Banking-Perdania Direct is on Transaction Status menu or a print out of transaction history of account.

10.2

Customer Admin and/or User may contact Helpdesk on any problems related to transactions using Internet Banking-Perdania Direct service in the phone number 021 – 570 1958 on Monday to Friday (except Bank’s holidays) on 08.20 am to 05.00 pm.

10.3

Bank has the right to modify this Terms and Conditions at any time with notice to Customer Admin and/or User in any forms and manner that is commonly used by the Bank not later than 30 (thirty) working days before the changes implemented.

10.4

User shall be subjected to the provisions and regulations imposed by the Bank as well as the requirements for the opening accounts, including changes that will be informed by the Bank in a manner that is commonly used by the Bank not later than 30 (thirty) working days before the changes implemented.

10.5

The authorization in this Terms and Conditions are legitimate powers that irrevocable and unconditional which is valid as long as the User is still provided with the Internet Banking-Perdania Direct service or the User still has other obligations to Bank.

10.6

This Terms and Conditions are made in Indonesian and English. If there are any discrepancies in the writing, the meaning, and interpretation, the Indonesian version prevails.

10.7

This Terms and Conditions are fully governed and construed according to the laws of Republic of Indonesia.

10.8

This Terms and Conditions has been adapted to the regulations including the regulations of the Financial Services Authority (OJK).

10.9

The legal and permanent domicile area is at the Clerk Office of Central Jakarta District Court or at the other courts specified by the Bank and the User in the territory of The Republic of Indonesia.
