Bank Indonesia Regulation No. 12/1/PBI/2010 dated January 28, 2010 which revoked Bank Indonesia Regulation No. 10/7/PBI/2008 dated February 19, 2008 regarding Non-Bank Company Foreign Loan

                                               ANNOUNCEMENT


In connection with Bank Indonesia Regulation No. 12/1/PBI/2010 dated January 28, 2010 which revoked Bank Indonesia Regulation No. 10/7/PBI/2008 dated February 19, 2008 regarding Non-Bank Company Foreign Loan, therefore we informed that for Non-Bank Company, such as: State Owned Company, Municipal Company, Private Company that will be conducting Short Term Non-Bank Company Offshore Loan (for term until 1 year) or Long Term (more than 1 year), even directly from creditor or money market either indirectly from affiliation or non-affiliation in the type of loan as following:

 

1.       Loan in rupiah or foreign currency that conducted based on Loan Agreement with Non-Resident.

2.       Bond in foreign currency that issued in international or national market money through general offering.

3.       Bond in rupiah or foreign currency that issued through privet placement for Non–Resident.

4.       Bond in foreign currency that issued in national money market through general offering.

5.       Bond in foreign currency that issued through private placement for resident

6.       Others obligation for non–resident in foreign currency or rupiah except the foreign loan as mentioned in the above

7.       Obligation type and bond as mentioned in the above based on syariah principle

 

We herewith informed that:

  • For company that will conduct the Short Term or Long Term Foreign Loan must implement the Risk Management functions, which consist of: market risk, liquidity risk, and operational risk.
  • For company that has a plan to get Long Term Foreign Loan must submit the report to Bank Indonesia in correctly and completely regarding: report of foreign loan plan for 1 (one) year, analysis result of risk management company, rating, financial ratio, and financial report. Obligation to submit the rating reports to Bank Indonesia just prevailing for the company that owned rating. The reports must be submitted at the latest on March 10 in related year or in the next day if the date is holiday.
  • For company that has position of Short Term and/or Long Term Foreign Loan must submit the report to Bank Indonesia in correctly and completely regarding: financial ratio and financial report that submitted every 6 (six) month (every semester), at the latest on June 10 and December 10 or in the next day if the date is holiday. 
  • If there is any change in the plan to obtain Long Term Foreign Loan and/or analysis report of risk management company and/ or Company which has new plan to do Long Term Foreign Loan after March 10, so the Company must submit the changes report to Bank Indonesia with explanation of changes at the latest July 1 in related year or in the next day if the date is holiday. 

The report is confidential and Bank Indonesia will give penalty in the form of notice letter to the authority institution if the company not submit the reports/ not complete.

 

This Regulation effective on January 28, 2010 and the penalty will be effective on January 1, 2012.
